The Horseland site is owned and operated by Horseland LLC a Delaware company (referred below as: "Horseland", "us", "we", the "Site" or "our").

The Horseland game is a special part of the site where players may play a game of imaginary horses. To make that possible we do not allow players to harass other players, use rude, obscene or obnoxious language. It is the players responsibility to make sure they have the right to use any referenced or uploaded information or images. We also may change the rules of the game at any time, including, but not limited to, the point system, the amount of game money a player receives and the number of horses a player may have. Players that do not follow these rules may be terminated from the game without refund. Fees and privileges may be changed at any time without notice. If players do not agree with these terms of service their only remedy is to stop using the service.

This game is designed for people to use by displaying the pages in a browser and clicking the buttons or links by hand. Using programs or scripts to play the game may damage our game, prevents access for other players, increases our costs and is not allowed. Any player who we detect is using such scripts or programs can have their account blocked and all horses, pet or other content deleted or points removed.

The Horseland web site has several areas. There are areas of content created by Horseland LLC and areas with content that is created and owned by users of the service. Horseland LLC is not responsible for the areas of the site with user created and managed content. By uploading or otherwise submitting any materials to Horseland, you (and your parents, if you're under age 18) automatically grant (or warrant that the owner of such rights has expressly granted) to Horseland a perpetual, royalty-free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology (now known or hereafter developed or devised) throughout the universe. In addition, you warrant that all so-called "moral rights" and other rights recognized throughout the world (including without limitation, the European Economic Community) in those materials have been waived.

You hereby further agree that you will not upload to, distribute through, or otherwise publish through or in conjunction with the Site, any materials that are libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or that would constitute or encourage a criminal offense, violate the rights of any person, or otherwise violate any law or give rise to liability.

You hereby consent to the extraction of hardware system profile data and any data related to operation of the software from any computer that logs on to the Site using your account. Horseland will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity. Specifically, Horseland may disclose information about you or the content of your user created pages or postings (including but not limited to chat, messages and homepage content) if Horseland has the good faith belief that such disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms; (c) respond to claims that any of the content of your user created pages or postings (including but not limited to chat, messages and homepage content) violates the rights of a third party; or (d) protect the rights, property or safety of Horseland, its members or the public. Horseland may be used for noncommercial purposes only. You are not permitted, without our express written approval, to distribute or otherwise publish any material containing any solicitation of funds, endorsements (including of a political, sexual orientation, or social cause nature), promotions, or advertising, or solicitations of any kind or nature. You specifically acknowledge that soliciting other Horseland' users to join or become members of any commercial online service or other organization or group (profit, non-profit, social, political, or otherwise) is expressly prohibited.

You are solely responsible for your interactions with other users. Horseland reserves the right, but has no obligation, to monitor disputes between you and other users.

INDEMNIFICATION
You are entirely responsible for maintaining the confidentiality of your login name(s), password(s), and your account, as well as all activities that occur under your account. Horseland operates and controls the Site from its offices in the United States of America. Horseland makes no representation that the Site is appropriate or available in other locations. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Software from this Site is subject to United States export controls. The failure of Horseland to exercise or enforce any right or provision of the terms of service shall not constitute a waiver of such right or provision. If any provision of these terms of use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the terms of service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
